3° Fraction V

In addition to providing preschool, primary, secondary and upper secondary education, indicated in the first paragraph, the State will promote and will attend all types and educational modalities - including initial education and higher education - necessary for the development of the nation, will support scientific and technological research, and will encourage the strengthening and diffusion of our culture.

3° Fraction VI

Individuals will be able to provide education in all its types and modalities. In the terms established by law, the State will grant and will withdraw the recognition of official validity to the studies carried out in private schools. In the case of preschool, primary, secondary and normal education, individuals must:

a) Provide education with adherence to the same purposes and criteria established in the second paragraph and section II, as well; how to comply with the plans and programs referred to in section III.

b) Obtain previously, in each case, the express authorization of the public power, in the terms established by law.

5° Second paragraph

The law will determine in each federative entity, what are the professions need a title for their exercise, the conditions that must be fulfilled to obtain it and the authorities that must issue it.

73° Fraction XXV

The Congress has the power: To establish the Professional Teaching Service in terms of article 3. of this Constitution; establish, organize and sustain throughout the Republic rural, elementary, superior, secondary and professional schools; from scientific research, fine arts and technical education, practical schools of agriculture and mining, arts and crafts, museums, libraries, observatories and more institutes concerning the general culture of the inhabitants of the nation and legislate in everything that refers to these institutions; to legislate on vestiges or fossil remains and on archaeological, artistic and historical monuments, whose conservation is of national interest; so as to enact laws aimed at conveniently distributing between the Federation, the federative entities and the Municipalities the exercise of the function education and the economic contributions corresponding to that public service, seeking unify and coordinate education throughout the Republic, and to ensure compliance with the aims of education and its continuous improvement in a framework of inclusion and diversity. Law for the Coordination of Higher Education

The type of higher education is the one taught after high school or its equivalent. It includes normal education, technology and university and includes short professional careers and studies leading to bachelor's, master's and doctorate degrees, as well; as refresher and specialization courses.

It is the responsibility of the Federation to ensure that the names of higher education establishments correspond to their nature.

The authorization to impart normal education and the recognition of official validity to other higher-type studies will be governed by the Federal Education Law, by this Law and by the agreements to which it refers. , in the understanding that for each campus, extension, dependency and curriculum, authorization or recognition will be required, as the case may be.

The authorization referred to in the previous paragraph, may be granted by the governments of the States only when the schools operate in their territory.

The certificates, diplomas, diplomas and academic degrees issued by individuals with respect to authorized or recognized studies will require authentication by the authority that has granted the authorization or recognition or, where appropriate, the decentralized public body that has granted recognition.

The authority or decentralized public body that grants, as the case may be, the authorization or recognition will be directly responsible for the academic supervision of the educational services for which it was granted said authorization or acknowledgment.

Individuals who teach higher-type studies with authorization or recognition of official validity must register with the Ministry of Public Education.

Failure to comply with this provision will motivate the imposition of a fine of up to one hundred thousand pesos, and in case of persisting non-compliance, it will be possible to close the educational service.

The education provided by the State, its decentralized agencies, and individuals with authorization or with recognition of official validity of studies, it is a public service.

They constitute the national educational system:

I.- Students, educators and parents;

II.- The educational authorities;

III.- The Professional Teaching Service;

IV.- Educational plans, programs, methods and materials;

V.- The educational institutions of the state and their decentralized organisms;

VI.- Individual institutions with authorization or with recognition of official validity of studies;

VII.- Higher education institutions to which the law grants autonomy;

VIII. The educational evaluation;

IX.- The Educational Information and Management System, and

X.- The educational infrastructure.

In addition to the exclusive attributions referred to in articles 12 and 13, the federal and local educational authorities concurrently have the following powers:

IV.- Grant, deny and withdraw the recognition of official validity to studies other than preschool, primary, secondary, normal and others for the training of basic education teachers taught by individuals.

II.- The fundamental contents of study, organized in subjects or other learning units that, as a minimum, the student must certify to fulfill the purposes of each educational level;

III.- The essential sequences that must be respected between the subjects or learning units constituting an educational level, and

IV.- The criteria and procedures for evaluation and accreditation to verify that the student complies the purposes of each educational level. In the study programs, the specific learning purposes of the subjects or other learning units within a curriculum, as well as the criteria and procedures to evaluate and certify its compliance. They may include suggestions on methods and activities to achieve those purposes.

Individuals will be able to provide education in all its types and modalities.

Authorizations and acknowledgments of official validity of studies will be granted when applicants have:

I.- With personnel who certify the adequate preparation to teach education and, where appropriate, satisfy the other requirements referred to in article 21;

II.- With facilities that satisfy the hygienic, safety, pedagogical and accessibility conditions that the granting authority determines, in accordance with the terms indicated in the applicable provisions. To establish a new campus, a new authorization or recognition will be required, depending on the case, and

III.- With study plans and programs that the granting authority deems appropriate, in the case of education other than preschool, primary, secondary, normal, and others for the training of teachers of basic education.

First paragraph

The educational authorities will publish, in the corresponding official information body and in their electronic portals, a list of the institutions to which they have granted authorization or recognition of official validity of studies, as well as as well as those they have authorized to revalidate or match studies. They will also publish, in a timely manner and in each case, the inclusion or the deletion from said list of the institutions to which they grant, revoke or withdraw the respective authorizations or acknowledgments.

Fourth paragraph

Individuals who teach studies with authorization or with recognition must mention in the documentation that they issue and in the advertising they make, a legend indicating their status as incorporated, the number and date of the respective agreement, as well as as the authority that granted it.

Individuals who provide education with authorization or with recognition of official validity of studies must:

I.- Comply with the provisions of article 3. of the Political Constitution of the United Mexican States, in this Law and other applicable provisions;

II.- Comply with the study plans and programs that the competent educational authorities have determined or considered appropriate;

III.- Provide a minimum of scholarships in the terms of the general guidelines that the authority that grants the authorizations or acknowledgments has determined;

IV.- Comply with the requirements set forth in article 55, and

V.- Facilitate and collaborate in the evaluation, inspection and surveillance activities that the competent authorities carry out or order.

The authorities that grant authorizations and acknowledgments of official validity of studies shall inspect and monitor the educational services for which said authorizations or acknowledgments were granted. The authorities will endeavor to carry out an inspection visit at least once a year.

To carry out an inspection visit you must show the corresponding order issued by the competent authority. The visit will take place in the place, date and on the specific matters indicated in said order. The person in charge of the visit must identify yourself properly.

Once the visit has been cleared, it will subscribe the corresponding act by those who have intervened and by two witnesses. In your case, it will be done to record in said act the refusal of the visited to sign it without this refusal affecting its validity. A copy of the minutes will be posted available to the visited.

Individuals may present documentation related to the visit to the educational authorities within five business days of the inspection date.

Of the information contained in the corresponding act as well As well as the related documentation, that individuals may present, the educational authorities may formulate corrective measures, which will be made known to individuals.

The educational authorities will issue the corresponding regulations to carry out the inspection and surveillance tasks.

First paragraph

Individuals who provide services for which studies are given without recognition of official validity, They must mention it in their corresponding documentation and publicity.

Studies carried out within the national educational system will be valid throughout the Republic.

The institutions of the national educational system will issue certificates and grant certificates, diplomas, academic qualifications or degrees to persons who have completed studies in accordance with the requirements established in the corresponding study plans and programs. Said certificates, certificates, diplomas, Titles and degrees must be registered in the Educational Information and Management System and will be valid throughout the Republic.

The Secretariat will promote that the studies with official validity in the Republic are recognized abroad.

Studies carried out outside the national educational system may acquire official validity, through their revalidation, for which you must comply with the general rules and criteria determined by the Secretariat in accordance with the provisions in article 63 of this Law.

Revalidation may be awarded by educational levels, by school grades, academic credits, by subjects or other learning units, as established by the respective regulation.

The Secretariat will determine the general standards and criteria, applicable throughout the Republic, to which the revalidation, as well as the declaration of equivalent studies.

The Secretariat may revalidate and grant equivalences of studies other than those mentioned in section V of article 13.

The local educational authorities will grant revalidations and equivalences only when they refer to plans and study programs taught in their respective skills.

The educational authorities and institutions that grant revalidations and equivalences will promote the simplification of said procedures, according to the principles of speed, impartiality, flexibility and affordability. In addition, they will promote use of electronic mechanisms to verify the authenticity of documents issued outside and inside the system national educational.

The revalidations and equivalences granted in terms of this article will be valid throughout the Republic.

The educational authorities may authorize or delegate, as the case may be, that private institutions with recognition official validity of studies and public institutions that do not have the express faculty in their regulations, grant revalidations and partial equivalences of studies regarding the plans and programs they teach, in accordance with with the general guidelines issued by the Secretariat.

The educational authorities may revoke the aforementioned authorizations, when there is any breach that in The terms of the aforementioned guidelines warrant such sanction. The foregoing regardless of the infractions that could be configured, in terms of the provisions of chapter VIII of this Law.

BY WHICH THE GENERAL BASES OF AUTHORIZATION OR RECOGNITION OF OFFICIAL VALIDITY OF STUDIES ARE ESTABLISHED.

The purpose of this Secretarial Agreement is to provide legal certainty to individuals who intend to teach in Mexico with official validity of the Mexican government, giving them the guarantee that the authority will not be able to demand higher requirements than those established in this Agreement and in the Agreement specific to the educational level in question.

BY WHICH THE PROCEDURES AND PROCEDURES RELATED TO THE RECOGNITION OF OFFICIAL VALIDITY OF STUDIES OF THE HIGHER TYPE ARE ESTABLISHED

The Regulation in article 41, indicates as attributions of the DGAIR, among others, that of granting and withdraw the acknowledgments of official validity of studies of the superior type, as well as how to elaborate and keep updated the statistics of the private schools that operate with authorization or recognition of official validity of studies granted by the Secretariat.

FRAMEWORK COORDINATION AGREEMENT ON RECOGNITION OF OFFICIAL VALIDITY OF SUPERIOR TYPE STUDIES.

Held between the Secretariat of Public Education and the State Educational Authorities on November 30, 2007

This Agreement establishes the commitment of the Secretariat of Public Education and the Educational Authorities to integrate the National Information System of the Recognition of Official Validity of Studies of the Superior Type, which must stay updated.
